The Pro’s Closet, Inc. (“TPC,” “we,” “us,” or “our”) developed this Privacy Policy to explain how we collect, use, disclose, and protect your Personal Information (defined below), and your choices about the collection and use of your Personal Information.

This Privacy Policy applies to Personal Information collected or processed through TPC-operated websites or applications (collectively, the “Site”) that link to this Privacy Policy

1.  What is Personal Information?

Personal Information” is information that, either alone or in combination with other information, identifies you. When we combine other information (i.e., information that does not, on its own, identify you) with your Personal Information, we treat the combined information as Personal Information.

2. How We Collect and Use Personal Information

In this Section, we describe the types of Personal Information we collect, and how we use Personal Information.

A. Information that You Provide Us

We collect Personal Information that you provide through your use of the Site, such as your name, home address, and email address. We also collect payment information, via third-party service providers, if you choose to purchase products through the Site.

If you use the Sell Your Bike/TradeUp area of the Site (or similar portal that we provide you access to on our Site or through one of our business partner’s sites) to request an offer from us, before we can purchase your bike or other items, we require you to provide government-issued identification information (e.g., a driver's license number).

We use this Personal Information only as necessary to provide the Site to you under the terms of our Terms of Service or for our legitimate interests in meeting your needs and expectations through the Site.  For example, we use this information to accept payments from you; respond to your inquiries regarding the Site, products offered on the Site, and your purchases; send you information about your orders, including confirmations and shipping information; process your application for employment; to help detect potential fraud and bike theft; to meet applicable legal requirements; and for other purposes related to the reasons for which you provide your Personal Information.

You may also provide us with your contact information, including your email or phone number, so that we may contact you regarding our services. With your consent, we may send you marketing communications, such as exclusive email updates and/or text messages and promotional offers relating to the Site and our services. These messages may use information automatically collected based on your actions while on the Site and may prompt messaging such as cart reminders. To the extent you voluntarily opt to have text notifications sent directly to your mobile phone, we receive and store the information you provide, including your telephone number or when you read a text message. You may opt out of receiving text messages at any time by texting “STOP” to our text messages. For more information about text messages, see our Terms of Service and any applicable SMS marketing terms that we make available to you. You may withdraw your consent to future communications, as described in this section and in Section 9 of this Privacy Policy.

B. Information We Receive from Your Use of the Site

We collect the following types of information through your use of the Site:

  • Cookies, Device Identifiers, and Similar technologies
  • When you use or access the Site, we use cookies, device identifiers, and similar technologies such as pixels, web beacons, and local storage to collect information about how you use the Site.  We process the information, including Personal Information, collected through such technologies to further our legitimate interests in operating the Site, enhance your experience through personalization, and help us better understand the features of the Site that you and other users are most interested in.   

    Some of our service providers (described in Section 3, below) may use cookies or other methods to gather information regarding your use of our Site or interactions with our communications. Such third parties may use these cookies or other tracking methods for their own purposes by relating that information with information that they may have. The use of such information by a third party depends on the privacy policy of that third party.

    Most browsers provide you with the ability to block, delete, or disable cookies, and your mobile device may allow you to disable transmission of device identifiers. If you choose to reject cookies or block device identifiers, some features of the Site may not be available or some functionality may be limited or unavailable.  If you disable cookies or device identifiers, you may continue to receive advertisements, but these advertisements will no longer be tailored to you. Please review your help pages of your browser or mobile device for assistance with changing your settings.

    Without an industry or legal standard of interpreting Do Not Track Signals (“DNT”) sent to us by your browser, we do not respond to DNT signals at this time. To learn more about how DNT works, please visit http://allaboutdnt.com/.

  • Log File Information:
  • When you use our Site, our servers automatically record information, including your Internet Protocol address (“IP Address”), browser type, referring URLs (e.g., the site you visited before coming to our Site), number of clicks, and how you interact with links on the Site, domain names associated with your internet service provider, pages viewed, and other such information (collectively, “Log File Information”). We may also collect similar information from emails sent to you which then help us track which emails are opened and which links are clicked by recipients. We use Log File Information collected from our implementation of the Site to further our legitimate interests in securing the Site by identifying potential threats and vulnerabilities, and in analyzing the effectiveness of our Site to improve the Site’s function and content.  

    3. Disclosure of Personal Information

    We will not disclose your Personal Information except as set forth in this Privacy Policy or with your consent.

    This section describes to whom we disclose Personal Information, and for what purposes:

      • Our Service Providers. We employ service providers to perform tasks on our behalf and to assist us in providing the Site, such as hosting services, analytics services, payment processors, marketing and communications services and shipping vendors.
      • Our Business Partners: We engage business partners to help us provide additional products and services to you.  For example, we may partner with a retailer to facilitate transactions where you trade in bicycles or components in exchange for a credit at the retailer’s stores.  The business partner’s use of Personal Information depends on its privacy policy. The identity of the business partner will be disclosed to you at the time of the related transaction or otherwise will be clear from the context (e.g., you will be directed to a business partner-operated web form from the site of the business partner).  
      • Google Analytics.  We use Google Analytics, an analytics service to help us analyze the traffic on the Site.  For more information on Google Analytics’ processing of Personal Information, please see “How Google uses data when you use our partners' sites or apps.”
      • Advertising: We engage advertising services to assist us in advertising our brand and Site.  From time to time, those services target advertisements on third-party websites based on cookies or other information indicating previous interaction with the Site.
      • Companies Involved in Mergers and Acquisitions Transactions.  If we sell or otherwise transfer part or the whole of TPC or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, or liquidation), any information collected through the Site, including Personal Information, may be among the items sold or transferred.
      • Law Enforcement, Government Agencies, and Courts:  We may disclose Personal Information at the request of law enforcement or government agencies or in response to subpoenas, court orders, or other legal process to establish, protect, or exercise our rights or to defend against a legal claim or as otherwise required or allowed by law, or to protect the rights, property, or safety of any other person. We may also disclose Personal Information to investigate or prevent a violation by you of any contractual or other relationship with us or your illegal or harmful activity. 

     

    4. Personal Information from Outside the U.S.

    If you are using the Site from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. The data protection laws of the United States might not be as comprehensive as those in your country. By using the Site, you consent to your information being transferred to the United States for the purposes described in this Privacy Policy.

    5. How We Protect the Confidentiality of Personal Information

    We use commercially reasonable safeguards to help keep the information collected through the Site secure. We also take appropriate measures to help ensure that our service providers with access to Personal Information provide an appropriate level of protection.  

    Despite these efforts to store Personal Information in a secure operating environment that is not available to the public, we cannot guarantee the security of Personal Information during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of Personal Information, we cannot guarantee that our security measures will prevent third parties such as so-called hackers from illegally obtaining access to Personal Information. We do not represent or warrant that Personal Information about you will be protected against, loss, misuse, or alteration by third parties.

    6. Children’s Privacy

    TPC does not knowingly collect or solicit any Personal Information from children. In the event that we learn that we have collected Personal Information from a child without parental consent, we will promptly take steps to delete that information.

    7.  Your Choices

    We provide you with access to—and the ability to amend or delete—certain categories of Personal Information through the My Account Details page. Our opt-out features, described in Section 9, also enable you to object to certain processing activities.  

    If you would like to access, amend, erase, export, or object to or restrict the processing of, your Personal Information, you may submit a request to customerservice@theproscloset.com.   We will promptly review all such requests in accordance with applicable laws.  

    8. Your California Privacy Rights

    California law permits users who are residents of California to request the following information regarding our disclosure of “Personal Information” (as defined by California law) to third parties for those third parties’ direct marketing purposes (i) a list of certain categories of Personal Information that we have disclosed to certain third parties for their direct marketing purposes during the immediately preceding calendar year, (ii) the identity of certain third parties that received Personal Information from us for their direct marketing purposes during that calendar year, and (iii) examples of the products or services marketed (if we have that information).     9.  Opting Out of Communications

    We may send notifications, newsletters, promotions, or other information via email or text messages (“Communications”). You may choose to stop receiving email Communications by following the unsubscribe instructions in any email you receive, and you may choose to stop receiving text-message Communications at any time by texting “STOP” to our text messages. Please note that certain service-related Communications are necessary for the proper functioning and use of the Site or our services and you may not have the ability to opt out of those Communications (for example, emails responding to your requests or providing confirmation of purchase).

    10.  Retention of Personal Information

    We will retain your Personal Information for the period necessary to fulfill the purposes for which your Personal Information has been collected as outlined in this Privacy Policy unless a longer retention period is required by law.  

     11. Other Websites and Services

    We are not responsible for the practices employed by any websites or services linked to or from our Site, including the information or content contained within them.  We encourage you to investigate and ask questions before disclosing your Personal Information to third parties.

    12. Changes to Our Privacy Policy

    TPC may modify or update this Privacy Policy from time to time, so please review it periodically. We may provide you with notice of material changes to the Privacy Policy as appropriate under the circumstances. Unless otherwise indicated, any changes to this Privacy Policy will apply immediately upon posting to the Site.
